Terms and conditions for digital permits for small businesses
The permits are available to businesses in receipt of Small Business Rate Relief and they will be able to apply for one discounted business permit. You must select one Elmbridge Council (EBC) car park when applying. See car park permit prices.
- Qualifying criteria - Each business in receipt of small business/retail rate relief will be able to apply for one discounted business permit. Typically, those in receipt of small business rate relief and/or retail, hospitality and leisure discount. The following must apply:
- rateable value of less than £15,000
- the property is occupied
- drive a minimum of 1 mile from their place of residence to their business address
- work within 800m of the car park
- Applicants will need to provide:
- Business Rate account number
- Letter on headed paper stating your position in the business and that the business property is occupied
- Vehicle. Acceptable documents include:
- the vehicle registration document (V5) showing your name and permit address
- a letter on headed paper from your employer stating the vehicle details, registration and that you have full time use of this company vehicle at the permit address
- a copy of the vehicle lease/ hire agreement showing your name, permit address and vehicle details
- a valid insurance policy schedule showing your name, permit address and vehicle details
The Council reserves the right to carry out spot checks on permit holders by requesting proof of their income at any time. If requested to do so, permit holders must produce evidence of their income within 10 working days of such request. Failure to produce the required evidence may lead to the Council revoking the permit.
- The permit may only be used in the car park(s) in which it has been issued. You cannot use your permit until you are notified that the permit has been authorised. Please allow up to 5 working days for your permit to be authorised.
- A virtual permit will be issued and therefore a paper permit does not need to be displayed in the vehicle.
- Failure to renew a permit before or on the expiry date may result in a Penalty Charge Notice being issued and a new application will need to be made.
- Permits are limited and are allocated on a first come first serve basis.
- A permit does not guarantee a parking space.
- Permit applications should be made online by accessing the link on the Council’s website. Any applicant who requires assistance with submitting an online application should contact MiPermit on 0345 520 7007 for assistance.
- Your car park permit application will be forwarded to Parking Services for their approval. If your application is approved, your payment will be processed. If your application is rejected, your payment will be returned to your account. The money can take up to 5 days to appear back in your bank account.
- If the incorrect documents are provided, Parking Services will request the correct evidence. Your application will be put on hold for up to 10 working days. If the evidence is not supplied within 10 working days your application will rejected as above.
- The Council reserves the right to refuse the issue of a permit or to cancel a permit in the event of misrepresentation or the supply of fraudulent information.
- Temporary changes of your vehicle details can be made using the online permit portal to cover periods of up to 2 weeks when a courtesy or temporary vehicle is in use in accordance with Clause 13.
- A permit holder must cancel their permit on the occurrence of any of the following events:
a) The permit holder ceases to own or use the vehicle in respect of which the permit was issued, unless there is a permanent change of vehicle in which case the permit can be amended online and evidence is submitted as stated in Clause 2. Only one permanent change is permitted per permit application as stated in Clause 13.
b) The business no longer qualifies for small business rate relief and/or retail, hospitality and leisure discount.
c) The business property is no longer occupied. - Permits can only be allocated to one vehicle at a time. You may make three temporary changes and one permanent change per application per year in line in Clauses 11 and 12 respectively. If incorrect vehicle details are supplied this will result in a Penalty Charge Notice being issued.
- The Council reserves the right to cancel a parking permit at any time subject to giving the permit holder seven days written notice. Where the Council cancels a parking permit a refund for the remaining full months of the permit will be made. Where a permit is cancelled because of fraud or misuse the permit holder will not be eligible for a refund.
- The permit may only be used for vehicles licensed as Private or Private Light Goods Vehicles.
- The Council’s Off-Street Parking Places Order 2019, as varied from time to time, applies to the issue and use of permits. These are available online at Off -street parking orders.
- You can cancel your permit at any time by logging on to the online portal. Refunds can only be obtained on the full months remaining.
- Refunds will only be given for unexpired complete calendar months.
- Exclusion of Liability - The Council does not undertake to supervise the parking place and will not accept any liability for loss or damage to motor vehicles or their contents howsoever caused, or injury to any person howsoever such injury is caused, unless or to the extent caused by proven negligence of the Council, its representatives or agents.
- Variation of Terms and Conditions - By applying for or purchasing any type of permit, the holder:
a) certifies that all the information provided in the application process is correct;
b) accepts the Council’s terms and conditions as varied from time to time; and
c) agrees to be bound by and comply with the relevant Traffic Regulation Orders which may be varied from time to time. - The Council reserves the right to amend these terms and conditions, application procedures and the relevant Traffic Regulation Orders and at any time.
- Any contravention of these Terms and Conditions will render the permit invalid and a Penalty Charge Notice may be issued.
- Data Protection and Fair Processing Notice for Forms
a) The Council is under a duty to protect the public funds it administers, and to this end may use the information you have provided on this form for the prevention and detection of fraud. It may also share this information with other bodies responsible for auditing or administering public funds for these purposes.
b) The Council will investigate any cases of suspected fraud or misuse of the permit. If the Council finds evidence of fraud or misuse it will suspend the permit and withdraw the facility to purchase Permits. The Council may also cancel permits already purchased, which may render the vehicle owner liable to pay a penalty charge. The Council may also prosecute vehicle owners where they consider that fraud or intentional misuse has taken place.
